Welcome to ImAllergicToIt. Please read the following Terms and Conditions ("Terms") carefully before using the Application. By creating an account and using our services, you agree to be bound by these Terms.
1. Description of the Service
ImAllergicToIt offers a free service that allows users to create, translate and manage personalised digital cards communicating food allergies and intolerances ("Allergy Card"). The service allows you to export cards in digital formats (e.g. PDF, PNG) to show at restaurants or hospitality venues.
2. Use of the Service, Medical Disclaimer and Limitation of Liability
Informational nature. The translations and information provided by the Application are a communication support tool. ImAllergicToIt does not guarantee that restaurant staff will correctly read, understand or respect the dietary restrictions shown on your card.
Medical disclaimer. The Application does not provide medical advice and is not a medical device. It is not a substitute for the judgement of a healthcare professional. You remain fully responsible for verifying the safety of the food you consume and for speaking directly with the staff who prepare it, especially in the case of severe allergies (for example, where there is a risk of anaphylactic shock).
Limitation of liability. To the fullest extent permitted by applicable law, ImAllergicToIt, its developers and its affiliates disclaim all liability for any allergic reaction, harm to health, or direct or indirect damage arising from the use of the service, from the translations it provides, or from any misunderstanding with catering or hospitality staff. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, or for fraud.
3. Account Registration and Security
Using the service requires creating an account. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Please notify us promptly if you believe your account has been accessed without your authorisation.
At registration you are asked to accept these Terms, to give a separate and explicit consent to the processing of your health data, and to declare that you are old enough to consent on your own behalf or are acting with the authorisation of whoever holds parental responsibility for you.
4. User Content
You are solely responsible for the data you enter into the Application (for example, the allergies and intolerances you select, their severity, and your notes). You warrant that the information you provide is accurate and is intended for your own personal use, or for the use of a person for whom you hold parental responsibility.
5. Personal Data
The processing of your personal data is governed by our Privacy Policy and our Cookie Policy, which form an integral part of these Terms.
The Application contains no third-party analytics, no tracking, no session replay, no advertising and no profiling. Nothing about your use of the service is sent to any analytics provider. Your allergies, intolerances, severity levels and notes are stored solely to generate your allergy card and are never used for any other purpose.
6. Costs and Changes to the Service
ImAllergicToIt is currently provided free of charge. We reserve the right to modify, suspend or discontinue the service (or any part of it) at any time. We may in the future introduce premium or paid features, and we will inform you in advance if we do. Where a change materially affects you, we will give you reasonable notice.
7. Intellectual Property
All intellectual property rights in the design, code, texts, icons and brand of ImAllergicToIt belong to the creators of the Application. Reproduction or unauthorised use for commercial purposes, outside normal use of the service, is prohibited. The content you enter remains yours.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict-of-law rules. The courts of Italy shall have jurisdiction over any dispute arising out of or in connection with these Terms.
Consumers in the European Union. If you are a consumer resident in the EU, the above does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence. You retain those protections, and you may bring proceedings before, and be sued only in, the courts of the country in which you are resident. EU consumers may also use the European Commission's online dispute resolution platform.
